The HOA Climate is ripe for litigation. Think about it - every homeowner, every house, every lot is worth a ton of money. Add to that the "elected" HOA 'bored' of neighbors are protected by multi-million dollar directors and officers liability insurance policies funded by your hard earned money in the form of your HOA dues.

Many of these policies are 'duty to defend' - whether they are right or wrong -the HOA board is protected. HOA lawsuits become a modern day lynching of the homeowner - even if they are simply fighting for their right to view the HOA's financial books and records. The board doesn't have to spend their life savings on litigation. The homeowner becomes the litigation feast's cash cow, is chewed up and left for scat!

There are stories of a court room scene in which "the busybody, too much time on their hands, lynch mob mentality HOA board of 'dictators' were planning a champagne party while their HOA lawyer was happily making objection after objection after objection, racking up the change. The lowly homeowner defendant just kept hearing ka-ching, ka-ching, ka-ching! The association lawyer once objected and then stood there dumbfounded as he realized he didn't even know why he had objected." We rest our case..................

Pray that your HOA never gets involved in litigation - particularly if you are one of the parties involved. There is a good chance you could be saying, BUH-BYE, to your house if you lose or even if you don't lose. Wanna take that chance?

Be aware of anyone (lawyer or otherwise) who advises you to sue or go up against a Homeowner Association in a lawsuit. IT IS AN UNLEVEL PLAYING FIELD AND HOMEOWNERS ALWAYS LOSE - WHETHER EMOTIONALLY OR FINANCIALLY.

Society is litigious enough as it is - add HOA Covenants Conditions and Restrictions, rules and regulations, by-laws, civil and corporate codes, and unethical lawyers, management companies and board member neighbors to the mix and you have the perfect cocktail for an intoxicating lawsuit.

Getting involved in HOA litigation is RISKY with a capital
R-I-S-K-Y! After all, it is your home that will be the collateral for any liability. Never mind what is left of your sanity, marriage, family life, and sadly even your children's innocence.
